2.1 Information You Provide: We collect personal information you explicitly provide to us when creating an account, subscribing to our services, or contacting support. This includes your name, email address, corporate affiliations, payment details, and billing addresses.

2.2 Automated Usage Data: We automatically collect telemetry and diagnostic data on how the services are accessed and used. This includes your device's Internet Protocol (IP) address, browser type, browser version, operating system, the pages of our Service that you visit, the time and date of your visit, session durations, unique device identifiers, and metadata regarding your interactions with the Service.

2.3 AI Prompts and Context Data: To provide our AI-driven solutions, we process the exact data, text prompts, files, code snippets, and conversational histories you submit to the HashWay VM or AI Agents.

3. Third-Party Data Processing, LLMs & Subprocessors

To deliver our AI-powered Services, we engage specialized third-party service providers who process your data on our behalf. These subprocessors include top-tier AI Model Providers (such as OpenAI, AWS Bedrock, Google Cloud, and Anthropic), authentication providers, and cloud hosting platforms.

We enter strictly negotiated Data Processing Agreements (DPAs) with these providers. They are contractually barred from utilizing your proprietary inputs, prompts, or corporate data to train, fine-tune, or benchmark their public, foundational, or proprietary AI models. By using our Service, you explicitly consent to the routing and processing of your data through these essential third-party integrations.

4. Zero AI Training on Customer Data

We enforce a strict "Zero Training" mandate. Absolutely no element of your private data, your Intellectual Property, your prompts, or any confidential materials you provide shall be used for training, fine-tuning, or augmenting any foundational AI model, algorithm, or system operated by AlgoHash. All outputs, code, texts, and insights generated through your authorized use of our Services immediately become and remain your exclusive property.

5. Data Sharing and Disclosure

AlgoHash will NEVER sell, rent, or lease your Personal Data to third parties for marketing or advertising purposes. We may only disclose your data under the following circumstances:

• Legal Compliance: To comply with applicable laws, court orders, subpoenas, or lawful requests by public authorities (including national security or law enforcement agencies).
• Service Providers: To our trusted subprocessors and contractors who assist us in operating our business and delivering the Service, bound by strict confidentiality obligations.

AS EXPLICITLY STATED IN OUR TERMS OF SERVICE, ALL SECURITY, DATA INTEGRITY, AND ACCOUNT PROTECTION ARE THE SOLE RESPONSIBILITY OF THE USER, NOT THE PLATFORM.

ALGOHASH INC. (THE PLATFORM) TAKES ABSOLUTELY NO RESPONSIBILITY AND SHALL NOT BE HELD LIABLE FOR ANY DATA LOSS, DATA BREACHES, HACKING INCIDENTS, RANSOMWARE, CYBER ATTACKS, OR IN ANY EVENT THAT CAUSES THE USER TO LOSE DATA, INTELLECTUAL PROPERTY, DIGITAL ASSETS, OR FINANCIAL ASSETS. YOU UPLOAD, STORE, AND PROCESS DATA ON THE PLATFORM ENTIRELY AT YOUR OWN RISK.

7. Data Retention and Deletion

We will retain your Personal Data only for as long as your account is active or as necessary to fulfill the specific purposes outlined in this Privacy Policy. We may retain archival copies of your data to comply with legal tax obligations, resolve disputes, and enforce our legal agreements. Upon verifiable request or account termination, we will securely delete or anonymize your Personal Data within thirty (30) days, barring legal retention requirements.
